Αποδεκτή έγινε από τον Υπουργό Περιβάλλοντος και Ενέργειας, Κ. Σκρέκα, η υπ’ αριθ. 50/2023 Γνωμοδότηση του Γ΄ Τμήματος του Νομικού Συμβουλίου του Κράτους, σχετικά με την συμμετοχή ειδών της άγριας πανίδας σε κάθε είδους παραστάσεις.
Το Ν.Σ.Κ. γνωμοδότησε κατόπιν ερωτήματος που υποβλήθηκε από το ΥΠΕΝ για τo
εύρος εφαρμογής και την ερμηνεία της διάταξης του άρθρου 23 παρ. 2 του ν. 4830/2021 (Α’ 169).
Ιστορικό (όπως αναφέρεται στο κείμενο της Γνωμοδότησης)
Με αφορμή καταγγελίες πολιτών προς διάφορες περιφερειακές δασικές υπηρεσίες, που αφορούν «βιωματικές παρουσιάσεις πτηνών» άγριας πανίδας, οι οποίες περιλαμβάνουν και ολιγόλεπτη ελεύθερη πτήση, πραγματοποιούνται δε από ειδικούς εκπαιδευτές-χειριστές σε κοινόχρηστους χώρους πρασίνου ή εντός αδειοδοτημένων και οριοθετημένων ιδιωτικών εγκαταστάσεων (με ενδεικτική αναφορά στις εγκαταστάσεις της ανώνυμης εταιρείας με την επωνυμία «Α…Α.Ε.» και του κοινωφελούς ιδρύματος με την επωνυμία «Β…»), αυτοβούλως ή μετά από πρωτοβουλία των ανωτέρω νομικών προσώπων ή τρίτων, όπως είναι τα θεματικά εργαστήρια άγριας πανίδας πανεπιστημιακών σχολών δασολογίας (με σκοπό την εξοικείωση των φοιτητών τους με τα πτηνά), υποβλήθηκε το υπό κρίση ερώτημα σε σχέση με την ερμηνεία και εφαρμογή των διατάξεων της παραγράφου 2 του άρθρου 23 του ν. 4830/2021. Συναφώς προς τα παραπάνω, η ερωτώσα υπηρεσία αναφέρει ότι με την υπ’ αριθ. ΥΠΕΝ/ΔΔΔ/88658/2929/02-09-2022 κοινή απόφαση των Υφυπουργών Περιβάλλοντος και Ενέργειας και Αγροτικής Ανάπτυξης και Τροφίμων προβλέπεται η δημιουργία εγκαταστάσεων προσωρινής ή μόνιμης φιλοξενίας ειδών της άγριας πανίδας σε εγκαταστάσεις (κτηριακές, κλωβούς, περιφραγμένους χώρους κ.λπ.), συμπεριλαμβανομένων και των Κέντρων Περίθαλψης Ειδών Άγριας Πανίδας, στις οποίες οι φορείς που τις δημιουργούν έχουν τη δυνατότητα να παρουσιάζουν στους επισκέπτες τα φιλοξενούμενα είδη της άγριας πανίδας, να αναφέρονται στο ιστορικό των ζώων που φιλοξενούν και να κάνουν περιγραφική αναφορά στο βιολογικό τους κύκλο και τα φυσικά τους ενδιαιτήματα, ανάλογες, δε, ρυθμίσεις περιέχουν και οι διατάξεις του π.δ. 98/2004 για τους ζωολογικούς κήπους, όπως ισχύουν.
Σύμφωνα με τη γνωμοδότηση γίνονται δεκτά τα εξής:Πρώτο ερώτημα
Επί του πρώτου ερωτήματος: Η διάταξη του πρώτου εδαφίου της παραγράφου 2 του άρθρου 23 του ν. 4830/2021 έχει την έννοια ότι απαγορεύεται η συμμετοχή όχι μόνο των ζώων συντροφιάς αλλά και των ζώων της άγριας πανίδας σε κάθε είδους παραστάσεις, χωρίς, σύμφωνα με ρητή πρόβλεψη του πρώτου εδαφίου της παραγράφου 1 του άρθρου 47 του ν. 4830/2021, να θίγονται τυχόν ειδικότερες διατάξεις νόμων ή διεθνών συμβάσεων, που προβλέπουν μεγαλύτερη προστασία για τα ζώα της άγριας πανίδας.Δεύτερο ερώτημα
Επί του δεύτερου ερωτήματος: Ως «κάθε είδους παραστάσεις», στις οποίες, σύμφωνα με το πρώτο εδάφιο της παραγράφου 2 του άρθρου 23 του ν. 4830/2021, απαγορεύεται η συμμετοχή με οποιονδήποτε τρόπο και για οποιονδήποτε σκοπό κάθε ζώου, νοούνται όλες αδιακρίτως οι παραστάσεις, στις οποίες υπάρχει πρόθεση για συμμετοχή κάθε είδους ζώου, χωρίς να ενδιαφέρει αν διαθέτουν σενάριο ή αν προβλέπουν παράλληλη με το ζώο συμμετοχή ανθρώπου ή αν ο διοργανωτής τους είναι εφοδιασμένος με την προβλεπόμενη από τις κείμενες διατάξεις άδεια λειτουργίας επιχείρησης θεαμάτων ή αν έχει δηλώσει την σχετική επιχειρηματική του δραστηριότητα στο φορολογικό μητρώο της Φορολογικής Διοίκησης με συμπλήρωση στο έντυπο Δ211 του αντίστοιχου Κ.Α.Δ.Τρίτο ερώτημα
Επί του τρίτου ερωτήματος: Στην έννοια των «κάθε είδους παραστάσεων» του πρώτου εδαφίου της παραγράφου 2 του άρθρου 23 του ν. 4830/2021 δεν εμπίπτουν οι «παρουσιάσεις» νόμιμα κατεχόμενων ζώων άγριας πανίδας στο κοινό, όπως οι έννοιες των όρων αυτών δίνονται παραπάνω, στους χώρους που αναφέρονται στο άρθρο 16 του ν. 4830/2021, καθώς και σε άλλους χώρους και υποδομές, όπως, ενδεικτικά, πάρκα, κοινόχρηστοι χώροι πρασίνου, βοτανικοί κήποι και άλλες νόμιμα λειτουργούσες ιδιωτικές εγκαταστάσεις, με την επιφύλαξη των ειδικότερων διατάξεων της κείμενης νομοθεσίας, ιδίως, ως προς τη διοίκηση και διαχείριση των χώρων αυτών και ως προς τα είδη ζώων άγριας πανίδας που επιτρέπεται να παρουσιάζονται σε αυτούς.Τέταρτο ερώτημα
Επί του τέταρτου ερωτήματος: Μόνο αρμόδιο όργανο να κρίνει πότε και αν συντρέχουν οι ειδικότερες προϋποθέσεις του δευτέρου εδαφίου της παραγράφου 2 του άρθρου 23 του ν. 4830/2021, είναι το Δημοτικό Συμβούλιο του Δήμου, εντός των ορίων της εδαφικής περιφέρειας του οποίου ζητείται άδεια για να πραγματοποιηθεί η εκδήλωση (πλειοψ.).
